Optimizing Settlements: The Power of Qualified Settlement Funds


Once you negotiate the settlement amount, several steps remain before the defendant is ready to sign and pay. Negotiating decisions on finance, tax, liens, and public benefits can stall your case for some time, especially when the defense is less experienced or unwilling to cooperate.

This presentation will discuss how qualified settlement funds (QSFs) can fast-track those conversations by allowing the defendant to pay, secure a release, and get a tax deduction. Once funds are secured, you can work with the plaintiffs (or delegate to others, including the QSF Trustee) on how to allocate, plan for immediate or deferred payouts, and mitigate client taxes.

The expert speakers will also discuss the limits of trial lawyers’ ethical obligations as well as client risks and strategies that should be considered.
