On November 4th, 2015 a man walked into a convenience store for a bottle of gatorade. He left with a severe TBI that caused memory and attention problems, chronic headaches, PTSD, depression, anxiety, grand mal seizures, visual disturbances, a detached retina, and tinnitus. This was a disputed liability case, and the trial was not without its unexpected challenges. The judge only allowed a 20-minute voir dire per side, and many members of the jury believed lawsuits were driven by greed and that verdicts are too high.
Despite these challenges, Eric Fong and his co-counsel, Ken McEwan and Emma Aubrey, persevered and the jury returned a verdict of $91 million, minus contributory negligence of 10 percent. Eric credits his mentors, co-counsel, and fiance with their immeasurable support in achieving this victory for his client. Eric Fong is a trial lawyer with an impressive career of over 100 cases tried to a verdict. Some of his landmark cases include the creation of the constitutional right of intimate association in Washington State, where Eric protected the rights of low-income housing residents against oppressive “crime control” measures. Eric represented George Clinton, the iconic funk musician/artist in the largest copyright case in American history, and helped him keep his catalog of work. With cases ranging from Murder to white-collar crime, and medical malpractice to toxic fume cases, even fewer lawyers can match the breadth of experience in various fields of law. Ben Wells has devoted over 25 years of his life to the representation of people who have been injured physically, emotionally, or financially by the negligence or malpractice of others. He has handled nearly a thousand cases in his career.
